This Privacy Policy relates to your use and access of SkyPop Partners LLC's ("SkyPoP's") smart phone customer loyalty application (the "Service"). This Privacy Policy should be read and agreed to alongside SkyPoP's Terms of Service before accessing the Service. In order for you to take full advantage of our Service, SkyPoP requires that you provide a certain amount of personally identifiable information ("Personal Information"). This Privacy Policy covers SkyPoP's treatment of Personal Information and other data that we gather when you are accessing SkyPoP's Service. The Service is not available to individuals who are younger than 13 years old.

What Personal Information Does SkyPoP Collect?

We receive and store any information you enter on our Service or provide to us in any other way. We collect basic Personal Information as a condition of using and accessing the Service. Basic Personal Information may include your name, phone number, email address and a password.

The Personal Information you provide is used for such purposes as allowing you to set up a user account and profile that can be used to interact with merchant programs through the Service, improving the content of the Service, customizing the advertising and content you see, and communicating with you about specials and new features.

Is Personal Information About Me Secure?

Your SkyPoP account Personal Information is protected by a code or password for your privacy and security. You need to prevent unauthorized access to your account and Personal Information by selecting and protecting your password appropriately, and limiting access to your phone, computer or and browser by signing off after you have finished accessing your account. SkyPoP endeavors to safeguard user information to ensure that user account information is kept private by storing your personal information on secure servers which are designed to ensure that your information stays private. However, SkyPoP cannot guarantee the security of user account information. Unauthorized entry or use, hardware or software and other factors may compromise the security of user information at any time. The Service may contain links to other sites. SkyPoP is not responsible for the privacy policies and/or practices on other sites. When linking to another site, you should read the privacy policy stated on that site. This Privacy Policy only governs information collected on the Service.

How is My Information Shared?

We will not sell, rent or use Personal Information in ways not described in this Privacy Policy.

Our Merchant Partners: Since SkyPoP is a customer loyalty application, we enter into relationships with a variety of merchants and work closely with them. Merchants are able to access information provided by SkyPoP that details anonymous behavior information in order to make relevant offers. Your Personal Information may also be shared with our Merchant Partners in order to provide you with the best Service possible, but all Merchants will be required to protect your Personal Information as a condition to doing business with us. While our Merchant Partners commit to providing you with a comparable level of protection of your Personal Information, we disclaim any liability for a breach of privacy by our Merchant Partners. You can be assured, however, that we will treat any such violations by our Merchant Partners seriously.

In addition, in certain situations our Merchant Partners may sell items or provide promotions to you through the Service. In other situations, SkyPoP provides services, or sells products jointly with these businesses. You can easily recognize when one of these businesses is associated with your transaction, and we will share your Personal Information that is related to such transactions with that business, unless you have elected not to be solicited by marketing partners during the registrations process or through the account settings page.

Agents: We may employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you. Our agents do not have any right to use Personal Information we share with them beyond what is necessary to assist us, and they provide a comparable level of protection for your Personal Information.

Business Transfers: If SkyPoP sells all or substantially all of its assets are acquired, or in the unlikely event that SkyPoP goes out of business or enters bankruptcy, Personal Information would be one of the assets that is transferred or acquired, and later used and accessible, by a third party.

Protection of SkyPoP and Others: We may release Personal Information when we believe in good faith that release is necessary to comply with the law, including laws outside your country of residence; enforce or apply our conditions of use and other agreements or protect the rights, property or safety of SkyPoP, our employees, our users, or others. This includes exchanging information with other companies and organizations (including outside of your country of residence) for fraud protection and credit risk reduction.

SkyPoP may also use the Personal Information that you provide so that we can track your purchasing habits, recognize you when you visit another Merchant Partner and provide you with relevant loyalty information/programs.

What Personal Information Can I Access?

When you login to the Service, SkyPoP will provide you with access to your Personal Information in order to update or correct certain portions of the information you have provided. This may include, without limitation, your first and last name, contact information, phone number, and email address.

Cookies

SkyPoP requires the use of cookies to operate at its best. If your browser/phone is set to reject cookies, you may have trouble using the Service. We use cookies so we know who you are when you back to the Service and we can keep track of your previous activity on the Service.

Will There Be Changes to This Privacy Policy?

SkyPoP may amend this Privacy Policy from time to time. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used. If we make material changes in the way we use Personal Information, we will notify you by posting an announcement on our Service or sending you an email. Users are bound by any changes to the Privacy Policy when they use the Service after such changes have been first posted.

Conflicts

In the event that there is a discrepancy between this Privacy Policy and the Terms of Service, the Terms of Service will be the authority on our policies.

California Civil Code Section 1798.83 permits users that are residents of California to request certain information regarding Company's disclosures of personally identifiable information to third parties for such third parties' direct marketing purposes.
